This Seller Agreement (“Agreement”) is a legally binding contract between Mobitez (“Mobitez”, “we”, “our”, “us”) and the individual or entity registering as a seller (“Seller”, “you”, “your”) on the Mobitez Seller Platform available at https://seller.mobitez.com.
By registering, accessing, or using the platform, you agree to be bound by the terms of this Agreement, along with all applicable policies referenced herein.
For the purposes of this Agreement:
• “Platform” means the Mobitez Seller Portal and associated systems
• “Seller” means any individual or entity listing products on Mobitez
• “Customer” means any end-user purchasing products
• “Services” means all tools, systems, and features provided by Mobitez including CRM, ERP, and accounting tools
• “Order” means a confirmed purchase made by a customer
Mobitez acts as a technology service provider and marketplace facilitator.
• Mobitez does not own or sell products
• Sellers operate as independent businesses
• No partnership, agency, or employment relationship is created
Seller must provide accurate:
• Personal/business details
• Contact information
• Bank and tax details
Mobitez may verify:
• Identity documents
• Business credentials
• Financial details
Seller is responsible for:
• Account security
• Activities conducted through the account
• Maintaining updated information
Mobitez operates on a Zero Commission Model.
• No commission is charged on product sales
• Sellers retain full revenue from product pricing
• Platform revenue is derived from subscription services
Access to platform features requires an active subscription.
Subscription includes:
• Marketplace access
• CRM tools
• ERP system
• Accounting and billing tools
• Order and inventory management
• Subscription fees must be paid in advance
• Non-payment may result in restricted access
• Fees are non-refundable unless stated otherwise
Seller agrees to:
• Provide accurate product descriptions
• Ensure product quality and authenticity
• Maintain inventory availability
• Comply with applicable laws
Seller shall be solely responsible for all listed products.
Seller shall:
• Accept and process orders promptly
• Ensure timely dispatch
• Provide proper packaging
• Handle customer issues
Failure to fulfill obligations may result in penalties.
Payments are governed by the Payment & Settlement Policy.
• No commission deductions
• Payment gateway charges may apply
• Settlements processed post-delivery
Mobitez provides transparent financial reporting.
Seller must:
• Accept valid return requests
• Process refunds as per policy
• Handle customer disputes
Applicable charges may be deducted.
Seller agrees that:
• ERP, CRM, and accounting tools are for business use only
• Data entered must be accurate
• Misuse or manipulation is prohibited
Mobitez is not liable for seller data errors.
Seller shall:
• Protect customer data
• Use information only for order fulfillment
• Not misuse or share personal data
Mobitez processes data as per Privacy Policy.
Seller grants Mobitez a license to use:
• Product images
• Descriptions
• Branding (for promotional purposes)
All platform elements are owned by Mobitez, including:
• Software
• Design
• Branding
Unauthorized use is prohibited.
Seller shall not:
• Sell illegal or restricted products
• Engage in fraud or manipulation
• Violate intellectual property rights
• Circumvent platform systems
Mobitez shall not be liable for:
• Business losses
• Product defects
• Third-party failures
• Indirect damages
Services are provided on an “as-is” basis.
Seller agrees to indemnify Mobitez against:
• Legal claims
• Customer disputes
• Policy violations
• Regulatory issues
Mobitez may suspend or terminate accounts due to:
• Policy violations
• Fraudulent activity
• Non-payment of subscription
• Legal issues
• Access to platform may be revoked
• Pending settlements may be held
• Data may be retained as per policy
Seller agrees to:
• Maintain confidentiality of platform data
• Not disclose sensitive business information
• Protect proprietary systems
Mobitez shall not be liable for failure due to:
• Natural disasters
• System failures
• Government actions
• Unforeseen events
This Agreement shall be governed by the laws of India.
All disputes shall be subject to jurisdiction of competent courts.
Mobitez reserves the right to update this Agreement.
Continued use implies acceptance of revised terms.
This Agreement, along with all policies, constitutes the full agreement between the Seller and Mobitez.
