These Seller Terms & Conditions (“Terms”) constitute a legally binding agreement between Mobitez (“Mobitez”, “we”, “our”, “us”) and any individual or entity (“Seller”, “you”, “your”) registering, accessing, or using the Mobitez Seller Platform.
By registering as a seller or using the platform, you agree to comply with these Terms along with all applicable policies, including but not limited to the Privacy Policy, Payment & Settlement Policy, Product Listing Policy, and other platform guidelines.
If you do not agree with these Terms, you must not use the platform.
Mobitez is a technology-based platform that enables sellers to:
• List and sell products online
• Manage business operations using integrated tools
• Access CRM, ERP, and accounting systems
• Track orders, customers, and financial data
Mobitez acts as an intermediary platform and does not own, manufacture, or directly sell products listed by sellers.
To use the platform, sellers must:
• Be legally capable of entering into a contract under Indian law
• Provide accurate and complete registration details
• Maintain valid business and tax documentation (if applicable)
Mobitez reserves the right to approve or reject seller registration.
• Maintain confidentiality of login credentials
• Ensure all account information is accurate and updated
• Be responsible for all activities under the account
Unauthorized use must be reported immediately.
Mobitez operates on a 0% commission model.
• No commission is charged on product sales
• Sellers retain full product margin
• Revenue is generated through subscription-based services
Access to Mobitez platform features requires an active subscription.
• Subscription fees are charged monthly or as per selected plan
• Non-payment may result in restricted access
• Subscription fees are generally non-refundable
Sellers are solely responsible for:
• Accuracy of product information
• Product quality and authenticity
• Pricing and stock availability
• Compliance with applicable laws
Mobitez does not verify each listing and is not responsible for seller content.
Sellers must not:
• List illegal or prohibited products
• Provide misleading or false information
• Engage in fraudulent transactions
• Violate intellectual property rights
• Attempt to bypass platform systems
Violation may lead to account suspension or termination.
Sellers are responsible for:
• Processing orders on time
• Proper packaging and dispatch
• Ensuring product quality
• Managing returns and customer issues
Failure to fulfill orders may affect seller performance.
Payments are governed by the Payment & Settlement Policy.
• No commission deduction
• Payment gateway charges may apply
• Settlements are processed after delivery
Mobitez ensures transparency in financial transactions.
Returns and refunds are governed by platform policies.
Sellers must:
• Accept valid return requests
• Process refunds where applicable
• Comply with return timelines
Mobitez provides integrated business tools.
• Tools are provided for business management purposes
• Data entered must be accurate
• Misuse of tools is prohibited
Mobitez is not responsible for errors in seller-managed data.
Sellers must:
• Protect customer data
• Not misuse personal information
• Comply with data protection laws
Mobitez handles data as per its Privacy Policy.
Sellers must ensure that:
• They have rights to use product images and content
• They do not infringe third-party rights
Mobitez retains ownership of platform-related intellectual property.
Mobitez shall not be liable for:
• Seller business losses
• Product defects or quality issues
• Third-party service failures
• Indirect or consequential damages
The platform is provided on an “as-is” basis.
Sellers agree to indemnify Mobitez against:
• Legal claims arising from seller activities
• Violations of laws or policies
• Customer disputes caused by seller actions
Mobitez may suspend or terminate seller accounts for:
• Policy violations
• Fraudulent activity
• Non-payment of subscription fees
• Legal or compliance issues
Sellers may also request account closure.
Mobitez reserves the right to update these Terms.
Changes may be made due to:
• Legal requirements
• Platform updates
• Business changes
Continued use implies acceptance of updated Terms.
These Terms shall be governed by the laws of India.
Any disputes shall be subject to the jurisdiction of competent courts.
In case of disputes:
• Sellers must contact support first
• Issues will be reviewed internally
• Legal action may be taken if required
Mobitez shall not be held responsible for delays or failures caused by:
• Natural disasters
• Technical failures
• Government actions
• Events beyond control
These Terms, along with all policies, constitute the complete agreement between Mobitez and the seller.
